TERMS AND CONDITIONS FOR SALE
These Terms and Conditions of Sale apply to all transactions for the sale of goods on the Website. Please read them carefully. They do not affect your statutory rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Website. By accepting these terms and conditions you are forming a contract with us and agreeing to the terms and conditions that appear below. References to “you” and “your” are to you as an individual. References to “us”, “our” and “we” are to Our Shop.
All orders made by you through the website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.
If paying by cheque all cheques must clear first before we will send goods out.
You must ensure that the address for delivery is complete and accurate.
After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered.Please note this email is an acknowledgement and not an acceptance of your order .
We endeavour to keep the site updated at all times , however, there may be times when a product is temporarily out of stock and we will advise you when we expect to be able to fulfil orders, however this is an estimate only and shall not be binding upon us. If you order goods which are not availale from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, or cancel your order. You understand we are not liable to you for any failure or delay to fulfil an order due to products being out of stock, withdrawn or discontinued.
Once we have dispatched your order we are unable to cancel delivery, any orders that need to be cancelled after dispatch will need to be notified in writing and returned once they have arrived at their destination.
Delivery shall take place at the delivery address contained in your order and we cannot be held responsible if this delivery address is incorrect.
We cannot accept any liability for late deliveries which are due to circumstances outside of our reasonable control.
We shall not be liable for any direct,indirect or consequential loss , costs or expenses caused directly or indirectly by any delay in the delivery of the products.
If for any reason you or the person at the delivery address refuses to accept delivery of the products, or there is no one in to take delivery and you fail to make arrangments for redelivery, all risk in the products shall pass to you and we will charge a redelivery fee.We will not repost or refund your order until this fee has been paid.
The cost of delivery shall be calculated when you place your order with us and payment shall be due at the time of payment for the products.
Unless otherwise agreed between you and us, the price for the products shall be the price advertised on the date of the order.
Once the goods have been received by you,all risk of damage to, or loss of, the goods shall pass to you.If you intend to cancel your order and return goods you must keep good care of the goods pending return and they must be returned in the same condition, unwashed, tagged and free of all odours.Please the terms and conditions for returning items below.
All products carry the warranty and is limited to 28 days from purchase
Returns and Refund Policy
In the event that any order is incorrect, it must be notified to us within 7 (seven) days after delivery.
In the case of incorrect orders, the products shall be returned to us and we shall redeliver the correct order at our own cost.
If any products are faulty or defective, they must be returned to us within 28 days of delivery. At our own discretion, we shall replace the products free of charge and redeliver them at our own cost, or shall provide a refund or the price paid by you. In the event of replacement of any products, the products returned to us shall become our property.
If we choose to refund you rather than provide a replacement for faulty or defective products, or we are unable to replace any faulty or defective product, the products must be returned to us, at our cost, and shall become our property.
If you wish to cancel your order and return an item under the consumer protection(Distance Selling) Regulations 2000 you have a right to cancel your purchase.However to exercise this right you MUST notify us in writing, either email or letter within 7 working days from the day after you receive your goods.Please note a telephone call is not a valid cancellation and cannot be accepted as such. We will email a returns code to you. No returns will be accepted without this returns code as this is your proof of authorisation.
No right of cancellation, refund or return exists under the Consumer Protection (Distance Selling) Regulations 2000 once you have used your product, unless the product is defective and you are returning it for this reason.. .If you are returning your product because it is defective, please state the defect or defects.Repackage the product in its original packaging, including any accessories that came with the product. Unfortunately we will be unable to issue a refund where the product is in an incomplete state.
If the original packaging surrounding the product has been damaged or destroyed we will only issue a refund if the product is being returned due to a defect. If the original packaging of a defective product has been damaged or destroyed you should ensure that the returned product is adequately packed for shipment back to us.You are responsible for paying any postage or shipping costs incurred when returning the product.We will not issue refunds for any items lost or stolen in transit to us.Where a return is lost or stolen in transit to us, you should claim compensation from the company that shipped the return.
Subject to the above, we will refund the purchase price of a returned product within thirty days of receiving written notification of your intention to return the product.
We will also refund the cost of standard or recorded postage incurred returning a product, if incorrectly sent by us or where the product has been returned due to a defect. Please note that we will not refund any courier, overnight or express element of any delivery or postage charge, including Royal Mail Special Delivery.If you return an item outside of the given time set out in these terms and conditions we will not issue a refund and we will not resend item out unless postage is paid for in advance.Items returned without prior written notification will also not be refunded.You will have the option to have item resent at your own cost however.
Limitation of Liability
Without prejudice to the other provisions in these terms and conditions, these provisions set out our total financial liability to you.
Variation
We reserve the right to unilaterally vary these terms and conditions from time to time. You should check and read the terms and conditions for any updates and/or amendments before placing any order with us. If you do not agree to any of the terms and conditions at any time you should not place any order with us.
Law
These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
